One of the most common questions intended parents ask before beginning a surrogacy journey isn’t medical at all — it’s legal. Will the child be recognized as theirs? Will inheritance be an issue? Can the surrogate claim any rights later? India’s Surrogacy (Regulation) Act, 2021 answers each of these directly, and at KICdelfinium, we make sure our patients understand these protections before they begin treatment.

 Who Is Legally Considered the Parent?

Once a surrogacy arrangement has been completed within the bounds of the law:

  • The intended parents are recognized as the child’s legal parents.
  • The surrogate has no parental rights after the child is born.

 Are a Surrogacy Child’s Rights Equal to Any Other Child’s?
